Antilles Posted March 1, 2006 Share Posted March 1, 2006 The way I see it, there were 2 parts to Nites, the torrents and the forum, now that theres no torrents, its still a flamin great forum and Ill continue to visit and post as long as its around. Those who still hang around on the hope that torrents will return are misguided, theres plenty places to get torrents if thats your thing so I suggest you go look, but if its a great sci-fi, computing and gaming forum you want, then keep coming. Theres no reason this should disappear just coz theres no files for you to get anymore. And the petty "you misspelled this" posts are, quite frankly, childish IMHO! So leave it out please! All be it that Nite is a good man and that he has a family, this should not go down so easily. Seems like ya'll are just rolling over and taking it up the ars. I would be more than happy to start the whole tracker site agian but i know jack squat about torrents and all i know is where to DL them and how to DL them. English isn't my native language, so yeah, I'm obviouslly gonna misspell a few words here and there, mess up the grammar. I should HOPE that I've made it abundantelly clear by now that I am NOT in anyway an official spokesman for anything, as I've had MAYBE twenty more words from NiteShdw, then the majority of the rest of the forum, and I've been administrator for exactely 20 miniutes longer then the MPAA Lawsuit press release. Selling the website won't help NiteShadow, making money from an illegal activity would make it worst and he still would get sued. The funds required to fight a legal battle of that magnitude would run into the hundreds of thousands of dollars. Farfetched? I don't think so. If you win and the case is then appealed by the MPAA, the appeal costs an absolute fortune. Now also add to the equation the fact that Nite is a family man, and cannot risk the future of his family. So when anyone starts to spout the usual "you should fight this", just stop and think about the repurcussions. Lets also not forget Loki Torrents. Loki got $40 000 in contributions to his legal fund, which was then used to settle with the **AAs. His life was in tatters, but at least he did not land up having to fight a legal battle that realistically had no chance of succeding. Now as for the torrents that were downloaded - if the torrent had niteshdw.com as its tracker - forget it. If you want to create a new torrent with another tracker, that is your own choice. Sadly, it doesn't matter if the common man has done anything wrong or not. The American legal system is skewed towards the wealthy corporation in cases like this. While the situation might, in theory, be winnable who could really afford the legal battle? Unless a lot of lawyers want to do a great deal of pro bono work on a case like this, there is nothing that anyone could do. Nite did the only realistic thing. It is sad, since most of the torrents tracked through here were wonderful programs that might never again see the light of day. I don't see anyone rushing a "Man From Atlantis" DVD boxed set out onto the market... Hell, I'd buy it if they did, but there aren't enough people interested to make it viable. The loss of the tracker is a shame, but the forums are what originally brought me here, and here I stay. There are a lot of great folks here and that is the important thing. Recently, the law firm I work out settled a case between two corporations. The settlement was reached just before the trial began. To that point, the client's legal costs were in excess of $1 million. I, personally, don't understand why the civil legal system works the way it does. The truth of the matter is, the reason most people settle lawsuits is not because they are guilty, but because the settlement is often (far) cheaper than proceeding to trial. First, I'm not currently engaged in any lawsuits, as I have not been served. Second, the few donations I have received cover only my costs to run the server. This site is not a money-making site, it's a FAN SITE for fun. Third, I work a full-time job at which I get paid $28,000 a year. That basically means I live paycheck-to-paycheck. Now that the forum is the only remaining part of niteshdw.com, I may look to raising donations for a legal fund, but even if that happened, it won't bring back the torrent site, but it may help me keep my head above water. I only pointed it out so that although this was not an official post and you're not an official spokesman it looks a lot better and as more impact than a post with errors. Far from me the idea of starting a war over this so i'd like to apologise for the misunderstanding CHEERS !!! this is still a great forum with very good sci-fi issues .
