This sucks.

 

But I understand that niteshdw and the good people who has made this site into the oasis for us nerds that it is today has to look out for themselves. I, for one, appreciate everything they have done so far and I will definitely continue to frequent this community for as long as I am able. :)

Couple of points.

 

If there is legal action coming, let's hope that Nite isn't hurt by it. They can force him to take down the site, etc., but let's hope at it's worst that's all that happens, and that his equipments and resources aren't taken.

 

Secondly, isohunt says they and torrentspy are going to fight. This is exactly what we need. For those outside the US who don't know, and for those who don't understand the legal process, a court case can settle all these arguments, once and for all. Currently it is illegal to share a copyrighted item beyond your license. Von Helton, you may be a longstanding membr of the community, but you're blowing smoke. When you buy a CD, DVD or Pay Per View episode, you're licensed to listen to or watch it yourself, or have friends over, of take it to their hosue, etc., you're not licensed to convert it to MP3 or .avi and then share it with everyone else. While there's legal leeway that downloading it isn't infringement, bittorrent means you're gonna share it back, and THAT is illegal.

 

No bittorrent case has been to court, all sites have caved to Cease and Desist, or are in limbo. We need someone to stand up to cease and desist, take it to court, and have the courts declare the legal status of Bit Torrent. We can hope and pray the courts say it's ok.

 

What's a good omen is the Sith Law, passed earlier this year. The MPAA and Lucasfilm passed a law through the system saying specifically that releasing an unreleased, copyrightled motion picture to the net prior to theatrical release was an offense, punishable by law. That indicated that the MPAA and the studio didn't feel the current laws were enough to go on, that they had to stake out a specific area.

The arguments the MPAA, et al have is that this violates copyright and hurts their business. What will have to be shown is that this doesn't hurt their bottom line significantly. Also, Fair Use states that you can use a copyrighted item if:

 

1. The user owns a lawfully-acquired or purchased copy of the original work.

2. Few copies are made.

3. There is no significant effect on the market, or potential market, for the copyrighted work.

4. No similar product is marketed by the copyright holder.

 

Unfortunately, torrent sharing violates number 2 and number 4. 1 and 3 aren't in doubt. But many copies are made, and this may hurt the bottom line.

 

It's about time someone stood up and took this to court. The suits are crapping if it goes to court, as a court may say, "This actually raised interest in your show. This is not a violation of licensing, they can do what they want, once they own a copy of your show..."

 

But who cares if we can't get BSG, Trek or Dr. Who if Nite's damaged personally by this. Cross your fingers they fight only with letters, if at all, and not with a court case.

 

 

Right but what is needed here is a separation of movies and t.v. episodes.If movies are evil now then cool-shelve that and keep TNG and the rest online.This is stuff that people have seen MULTIPLE times and ill guarantee people have paid into again multiple times and just want desktop copies.Some of the series here like SAAB, the industry couldnt care less about.If they did they would be on DVD...seriously man,TV SHOWS,god this is so friggin overbearing and friggin stupid its stapid.

Thought is this though,if the movies are gone,its no longer a MPAA matter and Paramount,other distributors would have to file their own pherengal hassle suits?

I laugh at the MPAA, they think they can control the file sharing industry...Well i'd love to be the one to tell them they're a bunch of morons!

 

The way my world works when things like this happens is to go to my next favourite website on the list of 30 odd :) Hope to see you around guys and gals ;) happy "Connecting to other peoples computers and sharing individual packets in a specified order and position to compile into various interesting and useful formats"

We have to recognize, and understand that there's a huge difference between what WE find acceptable (ie "They already made their money off old TOS episodes") and what the MPAA finds acceptable (ie. "we sell TOS DVD's, so people should buy them.").

 

It's still up in the air as to what the law finds acceptable.

Well it still is "stealing". For example, based on American policy concerning digital media (radio, tv, movies etc) if a copywritten work is put into a medium such as cd's, dvd's, etc the original owner of the work can only expose him/herself and family (for example) to it. Mass exposure to this breaches copyright law.

 

Every "user" has to pay. Think of it like the line in a subway. Every person is supposed to deposit a token/quarter into the turnstyle machine to pay their entrance fee. This fee entitles the user to usage of the subway system for X amount of time/trips. Now imagine if I go to the turnstyle and put in my quarter but instead of going on through I simply hold it open so the next twenty people get in free. This is the same as copyright. Say a musical group releases a cd and only has one single on the radio, meaning if people want to hear the other tracks of their music they must purchase the cd. While I can buy the cd and listen to it, making copies and distributing them normally would mean each other user paying their fee to own that copy, just like a retail store...

 

I had a nice, detailed response to this that was lost when my friggin mouse fell and closed my browser. ARGH!!! So, let me try again, and preface this with "all due respect" :)

 

Anyway, the crux of it was, how is this any different from tape-trading? Many musical artists who have made it big on tape-trading/fan distributed music are now totally against it (Metallica comes to mind).

 

I think it all comes down to money, and the big-wigs want more.

 

And your argument is flawed; copyright has nothing to do with someone getting a free copy of this or that. Copyright was (and still is) related to ownership of an idea. For exapmle, as a musican, I can't go and steal riffs from "Don't Stop Believin" and try to make money off of them. THAT's what copyright laws are for: protecting concepts and ideas for artists so other people can't use them in their own works. All these lawsuits are nothing more than the corporations trying to make up for the bad singings they've made over the past ten years and haven't recouped on.

 

If I make a copy of Mariah's new album, she is still protected from me trying to use her lastest dance-fest, whether the compnay gets paid or not. It's the getting paid part that is a different story. The record companies/movie studios are trying to use "copyright infringment" as a scare tactic to get money. Nothing more. They can call it what ever they want, but copyright infringment? No, not true.

 

Ah man last post before i go ballistic but ill say that when Metallica turned into whiny schoolgirls over napster that was the last time i ever bought something of theirs.Their vehement pussery was so over the edge i couldnt believed i actually listened to their shit for as long as i did.

This all sucks. You have honest 'trek' fans like msyef (I bought everything I could as a kid, £1000's worth of stuff!) who fancy re-watching an ep, or backing up our collection that now cant due to the scumbags who download on the sly!

 

Totally wrecked my day, was looking forward to re-watching DS9, guess im gonna have to put it on hold as theres no way im gonna be able to afford to re-purchase everything. pfft.

Just to recap for everyone just joining us now:

 

- The MPAA announced in a press release that they plan on sweing a bunch of torrent sites, search indexes, and other large P2P networks.

- We have not recieved anything legal from the MPAA, or their lawyers at this time.

- We have volunterilly removed all the torrents, related software, and databases from the site.

- We will more then likely NOT have anything to do with the P2P scene in the future.

- I understand that a lot of people are feeling upset, disgusted, angry, afraid, and suspicious about recent things relating to the forum, but please try and remain calm, and objective.

Im just pissed off I guess. I can understand the need to 'police' torrents and what-not, just bloody annoying when you have decent people who have spent the ££ already that cant access episodes.

 

If a persons motives are to download and 'sell' - fair do's they deserve to be sorted out

I finally find a good site with a good community and beltin torrents set up courtesy of nite,just gutted by the new's and hope the establishment dosn't get it's way and nite come's out of this ok.

 

I know i don't post much but i can read,it's just thinking and typing at the same time that fry's me brain cell...

 

Thank **** i dont live in america at the moment cos it seem's you's cant even fart in your own house without someone coming down hard on you's but then again Blair and the rest of the muppet show in europe won't be happy till we follow suit. and please dont take this as a slating,i've got nothing against american's..honest

....just a hatred of the establishment, and money grabbing corps who fund them.

 

And yes i know all of this sharing is illegal,regardless of which country we're in,but we all like something for nothing..
